Age Discrimination in Employment Act¡¯ in Korea, US, and Netherlands: Its Concepts and Target Groups

Abstract
The purpose of this study was to examine legal provisions of ¡®Age Discrimination in Employment and Aged Employment Promotion Act¡¯ in Korea and to suggest directions for improvement of this Act. For this purpose, legal provisions of age discrimination acts of three countries including Korea were analyzed and examined. As is the case in Korea, the US and the Netherlands have in place age discrimination act separately from other anti-discrimination laws. The analysis tool of this study was composed around four questions: what is historical background of age discrimination act; does each country¡¯s age discrimination act include the four concepts of age discrimination; who are protected by age discrimination act; and what are the exemptions from age discrimination act. Major findings of this study are: first, the definition of age discrimination in the Act should include ¡®harrassment¡¯; second, with the goal of abolishing retirement age over time, retirement age should be adjusted upward to pensionable age, and; lastly, there should be a clear specification of the scope of the existing exemptions from age discrimination.
